Our goal at Affordable Legal Assistance is to hopefully get both spouses to work together to reach agreements on custody, visitation and financial issues in the manner that meets the needs of all family members, including the children. It is our intention to arm you with the facts regarding community property vs. sole separate property. We strive to get both spouses and their respective attorneys to agree not to take the case to trial. This process puts everyone involved on the same team. It has been our experience that trials do little to solve, and often perpetuates and intensifies conflict.

An annulment is a legal procedure which terminates a marriage between husband and wife. Annulling a marriage basically states that the marriage never technically existed and was never valid. Dissolution of marriage is the legal term for divorce. It primarily involves reconciling all the rights and obligations between you and your spouse, including custody and care of the minor children as well as child support and/or spousal support.

Judgment creditors can garnish your wages in order to collect the judgment. Creditors of a few types of debts (back taxes, child support, and student loans) can garnish your paycheck without a judgment. In most case the maximum is 25% of your disposable income. Garnishments to pay child support depend on whether you are currently supporting another spouse and/or child, other than the child who is the subject of the child support order. If so, up to 50% of your disposable income (what's left after mandatory deductions) can be garnished and sent to the child's other parent. If you aren't currently supporting anyone, up to 60% of your disposable income can be garnished for child support. Child Support is non-dischargeable in bankruptcy.

Filing for bankruptcy protection is designed to result in a discharge of most debts. Debts which are commonly non-dischargeable are student loans, IRS, spousal support or any outstanding tickets or violations. The law allows an individual or couple to file every 8 years. The most common signs of bankruptcy are when expenses exceed income, basically more money going out then coming in. This might be a result in loss of job, medical reasons or a vicious trap such as overspending. Another word for bankruptcy is a fresh start. The staff at Affordable Legal Assistance is friendly, knowledgeable and is sensitive to the needs during this stressful time. Answer: A Will is a one way ticket to probate. The worst mistake is not doing any pre-planning at all. The solution to avoid costly probate fees is having a Revocable Living Trust. Probate is the process of transferring property to heirs after someone dies. This process is accomplished under the direction of the court. Probate can last anywhere from 6 months to 2 years before the distribution of an estate. A Revocable Living Trust is a document which allows someone to distribute assets to heirs without the supervision of the court. Placing assets in a trust provides an orderly way to handle distribution of an estate in case of death. A trust avoids probate. Avoiding probate saves heirs lots of money and a long tedious court process that could have taken up to two years.
